Women Athletes File Major Lawsuit Against Transgender Inclusion In Their Sports

Charges that the NCAA has “institutionalised cheating and discrimination against women”

Sixteen female athletes have filed a lawsuit against the National Collegiate Athletics Association (NCAA) pertaining to the continued participation of transgender participants in their respective sports in the US.

The Times reports that the lawyer of the student athletes has charged that the organisation has “institutionalised cheating and discrimination” against them in sports including swimming, volleyball, tennis and track and field.

The suit charges that the NCAA has made a “radical departure from Title IX’s original meaning,” and is guilty of sex-based discrimination.

The complaint, filed in United States District Court in the northern district of Atlanta, Georgia,  also points to hundreds of female athletes being forced to share changing facilities with Lia Thomas, the transgender swimmer who at the time still had “full male genitalia.”

Thomas went on to claim the NCAA title in the women’s 500-yard freestyle event, beating two Olympic silver medal winners into second and third.

The complaint charges that “without notice to female swimmers competing in the 2022 NCAA Championships, the NCAA and … one or more other state actors or actors with apparent state authority … changed the designation of the locker rooms to be used by the women swimmers … to ‘unisex’ locker rooms.”

This was done, according to the suit “so that Thomas, a fully grown adult male with full male genitalia, would use the same locker rooms to be used by more than 300 female student-athletes, depriving the female student-athletes of sex-separated women’s locker room facilities and bathroom and restroom facilities where their right to bodily privacy could be protected.”

The complaint further charges that the women were exposed to “shock, humiliation, and embarrassment in violation of their constitutional right.”

The athletes, including swimmer Riley Gaines, are seeking an overturning of results in competitions where they finished behind trans competitors, and could be awarded damages in addition.

If they are successful, it could lead to significant changes in NCAA rules on the participation of transgender athletes in female categories.Under current NCAA rules, 

Transgender athletes are required to have had one year of testosterone suppression treatment, and provide proof that their levels are below the maximum allowable level for their sport.

Several sports at the Olympic and world level have banned trans athletes from women’s categories. If the lawsuit succeeds this could happen at the national level.

Bill Bock, former general counsel at the United States Anti-Doping Agency is representing the women. Bock told The Times that the “discrimination against female student athletes should disqualify the NCAA from being a sport governing body”.

Bock further charged that the NCAA “only requires an athlete to provide one testosterone result 28 days before competition, and that is not best practice as demonstrated by multiple international federations.”

“It is time for each of the NCAA’s sponsors, and for all sports organisations that care about fair competition and safe sport, to recognise the NCAA has institutionalised cheating and discrimination against women and must be reformed,” Bock further urged.

He added that the 2022 locker room incident in Atlanta was “nothing less than exploitation and a disgraceful violation of women’s rights.”

  4. Well, so they won’t allow trans-whatever from competing at the Olympic level. Isn’t that just peachy. Problem is, many actual females will have been cheated out of their rightful spots by then. So they will never make it to the Olympics to begin with. It’s very much too late by then and won’t mean squat. The ban has to start much earlier. Something like, NEVER allowing fake women in to begin with.
